1. Who are we

We (“NanoMatriX ” or “we” refer to NanoMatriX Technologies Limited of 18/F, Unit 6 & 7, Working field Commercial Bldg., 408-412 Jaffe Road) are a provider of authentication and traceability products and services on our platform (“Platform” means our website at www.nanomatrixsecure.com, www.complynexus.com, and our software, namely TrackMatriX SaaS, ComplyNexus, ComplyNexus PQE, ComplySpark, and Privicore Nexus). This Privacy Policy applies to all products and services offered by NanoMatriX Technologies Limited, including but not limited to TrackMatriX SaaS platform, ComplyNexus, ComplyNexus PQE, ComplySpark, and Privicore Nexus, anti-counterfeiting and anti-fraud consulting services, cybersecurity workshops, vulnerability assessments, and any other services provided through our website or third-party platforms. Note: if you are using services that are integrated or built using our products and services, the privacy policy of those services will describe how they collect, use, store, and share your information. We are not responsible for the privacy policies or actions of our customers or business partners.

This Privacy Policy applies to our customers, prospective customers, our customers’ customers (both direct and indirect), vendors, resellers, job applicants, current and former employees, contractors, visitors to our company websites, and recipients of our e-mail communications. Current employees are also governed by internal Human Resources policies, which are available upon request.

2. What information we collect about you

    1. We collect the following types of information about you:
      • Account and profile information that you provide when you register for an account or sign up for our products or services, for example your name, username or similar personal identifier, other personal description, job title, date of birth and gender, physical address (billing or delivery or both), email address, telephone number(s) (collectively, “Account Data”).

      • Details of any transactions, purchases, or orders that you’ve made with us(collectively, “Transaction Data”).
      • Payment information, for example your payment card information or bank account details (collectively, “Financial Data”).
      • Information about your device or connection, for example your internet protocol (IP)address, log-in data, browser type and version, time-zone setting, browser plug-in types and versions, operating system and platform, and other technology on devices you use to access our products or services and information we collect through cookies and other data collection technologies (please read our Cookies Policy for details) (collectively, Technical Data”); and Information about your use of or visit to our Platform, for example your click stream to, through, and from our Platform, products you viewed, used, or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods to browse away from the page(collectively, “Usage Data”).
    1. We collect the above information when you provide it or when you use or visit our Platform. We may also receive information about you from other sources, including:

      • Our personnel, agents, advisors, consultants, and contractors based in Hong Kong, Thailand, India, Pakistan, and the Philippines in connection with our operations or services, for example, our staff engaged in fulfilling your order, processing your payment, and providing support services.
      • Our business partners and service providers are based in Hong Kong, the United States of America, and Singapore, and they provide technical, payment, delivery services, advertising networks, analytics, market research, and search information services.
    1. We do not collect sensitive data or special category data about you. This includes your racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, and data about your health, sex life, or sexual orientation.

The information we collect includes “personal information,” which refers to any data, information, or combination of data and information that you provide to us or through your use of our products or services and that relates to an identifiable individual. It also includes non-personal information.

3. How we use the information we collect

    1. We only use your personal information where the law allows us to. We use your personal information only where:
      • We need to perform the contract we have entered into (or are about to enter into) with you, including to operate our products or services, to process transactions with you (such as billing), to authenticate you when you log into our platform, to provide customer support and personalized features, and to protect the safety and security of our Platform.
      • We have a legitimate interest in doing so. “Legitimate Interests” is a legal ground upon which we may process personal information, where that processing is necessary to pursue interests of our business provided always that your fundamental rights or data protection interests are not overridden as a result, for example for research and development. 4. How we share the information we collect

    1. We reserve the right to collect, share, and otherwise disclose non-personal information for any purpose except where limited by applicable laws, and to create non-personal information from personal information to do so.
    2. We may share information with third parties for research, analysis, profiling, and similar purposes to help us improve our products and services. If personal information is included, it will be strictly in an aggregated or de-identified form that does not specifically identify you.

If you use any third-party software in connection with our products or services, for example, any third-party software that our Platform integrates with, you might give the third-party software provider access to your account and information. We do not control policies and procedures of third-party software providers, and this policy does not cover how your information is collected or used by third-party software providers.     4. Our Platform may contain links to third-party websites over which we have no control. If you follow a link to any of these websites or submit information to them, your information will be governed by their policies.     5. We may share your information with government and law enforcement officials to comply with applicable laws or regulations, for example when we respond to claims, legal processes, law enforcement, or national security requests.

If we are acquired by a third party as a result of a merger, acquisition, or business transfer, your personal information may be disclosed and/or transferred to a third party in connection with such transaction. We will notify you if such transaction takes place and inform you of any choices you may have regarding your information.

5. How we transfer information internationally

    1. We collect information globally and primarily store that information in Hong Kong, Singapore, India, or the United States of America,. For the purpose of providing our products and services to you, we may transfer, process, and store your information outside your country of residence where we or our service providers operate.

6. How we store, secure, and retain the information we collect

    1. We use data hosting service providers based in Singapore, the United States of America, and India to host the information we collect.

      • Information is encrypted using TLS/SSL technology.
      • Your account is password-protected, with the requirement(s) that passwords must be at least 15 characters long, with a combination of letters, symbols, and numbers.
      • Access to your personal information is restricted to personnel or service providers on a strictly need-to-know basis, who will only process your information on our instructions and who are subject to a duty of confidentiality; and Our information collection, storage, and processing practices are reviewed regularly.

7. Your rights

  1. You have the right to:

  • Obtain confirmation on whether the person’s information is being processed by us. You also have the right to request a copy of personal information we hold about you.
  • Require us to correct any inaccuracy or error in any personal information we hold about you;

    1. Our products and services are not directed to individuals under 18. We do not knowingly collect personal information from individuals under 18. If we become aware that an individual under 18 has provided us with personal information, we will take steps to delete such information.
